definitions
“AgFed Credit Union,” is Agriculture Federal Credit Union d/b/a AgFed Credit Union.
“Affiliates”, an entity who provides products or services to AgFed Credit Union.
“Agreement,” shall refer to these Terms of Service from My Credit, as amended from time to time, along with any documents referred to herein and incorporated into the Terms of Service.
“Array”, a financial service platform that provides credit monitoring and identity protection tools.
“Credit Score”, a numerical rating that represents the perceived ability of a person(s) capability/potential to fulfill their financial commitments.
“Consumer Reporting Agency (CRA)”, is one of the National Credit Reporting Agencies that collect, analyze, and sell consumer financial data to lenders to assess credit worthiness.
“Debt-to-Income (DTI), a calculation that refers to the total amount of debt payments you owe monthly divided by your monthly income.
“National Credit Reporting Agencies” shall refer to Experian, Transunion, and Equifax.
“My Credit”, an online personal credit management service provided by Array.
“Privacy Policy,” refers to AgFed’s privacy policy linked on its website.
“Site” shall refer to the online banking website (mobile app or desktop) owned by AgFed Credit Union.
“Vantage Score 3.0”, an analytical scoring system that provides credit scores from the three (3) National Credit Reporting Agencies listed in the consumer reporting agency definition.
“Credit Alerts”, a notification from a credit monitoring service warning you about significant activity on your credit report.
“Credit Monitoring”, a service that tacks your credit report from the National Credit Reporting Agencies and alerts you to significant changes, like new accounts, inquiries, or potential fraud.
“You” and “your” shall refer to an individual member(s) that own of an account and are agreeing to these terms.
Terms of Service
Use of My Credit is subject to the following My Credit Terms of Service, as amended from time to time. You must accept the terms of service outlined below before you will be able to access My Credit. My Credit is supported by VantageScore 3.0 data and services. You agree to and hereby expressly instruct AgFed Credit Union to periodically obtain your credit report from service providers to use it for the following purposes:
- To display your credit score information to you for educational purposes to help you understand how financial transactions affect your credit score;
- To confirm your identity, such as identifying potential fraudulent transactions in your name; and
- To offer products and services that best suit your needs.
We may amend this Agreement and any applicable fees for My Credit at any time by posting a revised version of this Agreement in My Credit. The revised version will be effective at the time it is posted unless a delayed effective date is expressly stated in the revision. Any use of My Credit after a notice of change of after the posting of a revised version of this Agreement on our website will constitute your agreement to such changes and revised versions. Further, we may from time-to-time revise, update, upgrade or enhance My Credit and/or related applications or materials, which may render all such prior versions obsolete. Consequently, we reserve the right to terminate this Agreement as to all such prior revisions, updates, or enhancements.
Eligibility
You must be a U. S. resident, including any of the U. S. territories to enroll for and use My Credit. You must have sufficient credit history in your credit file(s) to generate a Vantage Score to provide credit information. If your Vantage Score cannot match you or is unable to provide credit information, you will not be able to use My Credit until such time you have built sufficient credit history. AgFed Credit Union also reserves the right to refuse access to My Credit at any time.
Registration and Authorization to Access MyCredit
If you choose to access My Credit, you will be required to provide personal information to register and enroll. You agree to provide accurate information in your registration and not share your AgFed Credit Union online banking username and password with third parties. You also agree to AgFed’s Member Agreement Online Services and not impersonate another person or select or use a username and password of another person. You further agree to notify AgFed and the National Credit Reporting Agencies promptly of any unauthorized use of My Credit and of any loss, theft, or disclosure of your online banking credentials. Failure to not comply with these requirements will constitute a breach of this Agreement and shall constitute grounds of termination of your My Credit access.
AgFed Credit Union will use the information already on file (including your name, Social Security number, birth date, and address) to verify your identity without any additional action required on your part. By clicking on the “Subscribe,” “Upgrade,” or similar button and signing up for the My Credit, you are providing written instructions under the Fair Credit Reporting Act (FCRA) and other applicable laws, including state laws, as amended, to Array—an AgFed service provider and its employees, agents, subsidiaries, affiliates, contractors, third-party data sources and suppliers, and all the National Credit Reporting Agencies, to release your credit report to AgFed Credit Union. By clicking on the “Subscribe,” “Upgrade,” or similar button and signing up for the My Credit you also agree and consent that AgFed may use the My Credit service to market other products and services from time to time and facilitate applications for those products and services.
You agree to access AgFed’s website and/or mobile app in compliance with our Terms and Use, which are available at www.agfed.org and incorporated into and made part of this Agreement by this reference.
The use of services located at www.agfed.org may not be authorized if we cannot verify your identity or other necessary information. Through your enrollment in our use of each service, you agree that we reserve the right to request a review of your identifying information through consumer credit and specialty reporting agencies. In addition, and in accordance with our online Privacy Policy, you agree that we reserve the right to obtain personal information about you including, without limitation, financial transaction activity.
If you are issued or create any password or other credentials to access the Service or the portion of the Site through which My Credit is offered, you agree not to give or make available your password or credentials to any unauthorized individuals, and you agree to be fully responsible for all actions taken by anyone to whom you have provided such credentials. If you believe that your credentials have been lost or stolen or that someone may attempt to use them to access the Site or My Credit without your consent, you must inform us at once as specified in this Agreement. Failure to contact us in a timely manner may impact your liability for unauthorized transactions.
By participating as a user of My Credit you attest that you are the owner of the email and/or U. S. mobile phone number and agree to receive this Agreement and all other communications from and regarding My Credit in electronic format to your email address and/or mobile number used in your registration and associated with your AgFed online and mobile banking profile.
My Credit Services
AgFed Credit Union will be offering My Credit basic services to its online and mobile banking members free of charge. Paid premium plans are also available and provided through My Credit. Through My Credit, you receive free access to your credit report, Vantage Score, credit alerts, credit score simulators and debt analysis.
- Vantage Score, a model created by the National Credit Reporting Agencies. The score(s) provided are for educational and informational purposes only. You can view your score as frequently as you like without impacting your credit score. My Credit Vantage Score will only evaluate account information that appears on your consumer credit report. Accounts not reported or subsequently deleted may not be reflected in your score. My Credit does not maintain your credit information and cannot make changes to it. AgFed will not be responsible for inaccurate results, including any due to incorrect or incomplete, or outdated information. Other financial institutions, or other services, may use other credit scoring methods, such as FICO© or other alternative versions of Vantage Score. AgFed may use a different scoring model, meaning your score may differ from the one shown on My Credit and impact your offered interest rate or credit denial. Your score through My Credit is updated every thirty (30) to forty five (45) days. To refresh your score, log in to My Credit after the thirty first (31st) day from your last update to verify.
- Alerts. Credit Monitoring tracks the health of your credit to help determine potential identity theft your credit and personal information. Credit Alerts include new inquiries, address changes, new derogatory information report about you, and new credit accounts opened using your personal information.
- Score Simulation. My Credit contains features that estimate how changes in your credit behavior may impact your credit score. My Credit does not guarantee whether your actual credit score will change by the same amount, in the same way, or at all.
- Debt Analysis automatically captures and synchronizes the debt record listed in your credit report. The debt-to-income (DTI) ratio includes monthly recurring debt and is utilized to determine what additional debt capacity you may have.
Marketing and New Features
You agree that by enrolling and using My Credit, you permit AgFed to periodically view your credit report to offer products and services that would suit your needs. We may, from time to time, introduce new features to My Credit or modify and/or delete existing features at our sole discretion. We will notify you of any changes to My Credit if legally required. By using the new/modified features when available, you agree to the rules and terms concerning these features.
Privacy and Information Security
We make security and the protection of your information a top priority. To better understand our commitment in maintaining your privacy, you can access our Privacy and Information Security Notice at Privacy Policy | Agriculture Federal Credit Union. The Notice (Privacy and Information Security Notice) is incorporated into and made a part of this Agreement by this reference.
Cancellation
For members enrolled in the My Credit basic plan, you may cancel your enrollment at any time by navigating to “Manage Account” and then by selecting the “Unenroll” option. To unenroll in a premium plan, you must first downgrade to the basic plan and then proceed to unenroll. Premium plan cancellation takes effect at the end of the current subscription period. Pro-rated refund will not be issued.
Termination
AgFed Credit Union may terminate, suspend, or limit access to My Credit in whole or in part for any reason without prior notice or change these terms and conditions at any time at our discretion. We may also determine other eligibility criteria at our sole discretion, subject to non-discrimination laws.
Governing Law; Severability
This Agreement is governed by our bylaws, federal laws and regulations, the laws and regulations of the District of Columbia. Any disputes regarding this Agreement shall be subject to the authority of the court of the county in which we are located. Each party waives, to the fullest extent permitted by law; (i) any objection which it may now or later have to the laying of venue of any legal action or proceeding arising out of or relating to this Agreement and all transactions it contemplates brought in any court in the county in which we are located; and (ii) any claim that any action or proceeding brought in any such court has been brought in an inconvenient forum. If it is held by the court or other lawful authority of competent jurisdiction that any term, provision, covenant, or condition of this Agreement is illegal, invalid, or unenforceable, in whole or in part, such provision will be ineffective to the extent of such illegality, invalidity, of this Agreement; such remaining provisions will continue in full force and effect, provided the effectiveness of the remaining portions of this Agreement will not defeat the overall intent of the parties.
